Do you need WEEE registration to sell electronics into the EU from a Shopify store?

Are you a WEEE producer if you sell electronics online?

Directive 2012/19/EU defines a producer “irrespective of the selling technique used, including distance communication”. Article 3(1)(f)(iv) covers anyone who:

sells EEE by means of distance communication directly to private households or to users other than private households in a Member State, and is established in another Member State or in a third country.

Both cases reach a Shopify store: based in another EU country or outside the EU, you are a producer in every EU country you sell to directly by distance where you are not established.

Where do you register, and when is a representative required?

You register where you sell. Article 16(1) says distance sellers “shall be registered in the Member State that they sell to”, and continues:

Where such producers are not registered in the Member State that they are selling to, they shall be registered through their authorised representatives as referred to in Article 17(2).

For a store outside the EU, the representative rule is the Article 16(1) sentence in the quote above; Article 17(2) itself does not name third countries.

A store established in another EU country appoints an authorised representative in each EU country where it sells by distance but is not established (Article 17(2)), by written mandate (Article 17(3)).

In Germany, the register stiftung ear tells a foreign company: “you cannot register yourself.”

None of the three Shopify Help Center pages we read on 25 September 2026 (GPSR, consumer protection, Managed Markets prohibited items) describes WEEE registration or appointing a WEEE authorised representative.

Is WEEE separate from battery and packaging registration?

Yes. Batteries are a separate producer duty under Regulation (EU) 2023/1542, covered in our battery producer answer.

Packaging is another separate stream with its own registers, set apart in the rules people confuse with packaging EPR.
